HR Complaints - Survival Guide

How to Survive a Frivolous/False HR Complaint

1. DO NOT accept "Anonymous" complaints. Demand to know who made the complaint.

2. Demand to see the exact details of the complaint. Don't get info 2nd hand.

3. Demand that the complaint be made official (via email/letter) and goes through official channels.

4. If points 1, 2 & 3 are NOT met DO NOT participate in the process.

5. Capture everything in writing and record conversations.

6. Never apologise or admit fault if you've done nothing wrong and DO NOT back down.

7. Be prepared to be treated like the enemy (especially if you're a man).

8. DO NOT lose your cool ... this will be used against you.

9. Be prepared to submit a counter claim against the person who submitted a claim against you (use the words bullying, intimidation and creating a hostile work environment).

10. DO NOT resign, make them fire you.

11. Be prepared to make an unfair dismissal claim with the appropriate authorities if justice is not served.

12. If you are fired ensure that all your former colleagues know exactly why you were fired (facts only - name of complainer and basic outline of scenario).


Conclusion

Frivolous and false complaints are vindictive power plays designed to intimidate and bully. The complainer is usually waiting for an apology/admission of guilt. If you don't provide them the apology/admission they are usually not prepared for the next step in the process (actually backing up their claim with facts). Following the plan above will most likely result in a withdrawal of the complaint or dismissal of the complaint. 

Note: The stratagem above will only work if the claim is false or frivolous. If the claim is legitimate I'd recommend an honest and conciliatory approach.
